BENJAMIN R. GARDNER
The firm is saddened
by the passing of our beloved friend and partner,
Benjamin R. Gardner.

Ben exemplified the
role lawyers should play in advancing and bettering the
community in which he lived and worked. His exemplary
service to the community resolved frictions between
Martinsville and Henry County, and resulted in the
formation of an effective Economic Development Corp. We
regret Ben did not live to see one of the biggest fruits
of his labor – the recent announcement of the location
of a major new industry here.
Ben’s courage in the
face of his 15 year battle against long odds with cancer
and his ministry to and support of others facing similar
difficulties will long stand as a beacon of hope and
optimism.
FIRM’S 2007 VERDICT INCLUDED IN VIRGINIA LAWYER’S
WEEKLY’S LISTING OF LARGEST VERDICTS IN VIRGINIA IN 2007
The firm’s $2.5 million dollar verdict in the
2007 jury trial of Johnson v. Hairston was among
the 20 largest verdicts in Virginia in 2007. Philip G.
Gardner and James J. Reynolds successfully represented
catastrophically injured Lisa Johnson in a claim against
a Virginia State Trooper in a near fatal automobile
crash. Such cases are particularly difficult in
Virginia because the Plaintiff must establish gross
negligence.
PHILIP G. GARDNER NAMED TO “SUPER LAWYERS” LISTING
FOR SECOND CONSECUTIVE YEAR
In 2006, Richmond Magazine included Philip G.
Gardner in its top Virginia lawyers listing. The 2006
listing was for excellence in criminal law. The 2007
listing was for excellence in Plaintiff’s personal
injury law.

VIRGINIA STATE BAR LITIGATION SECTION NEWSLETTER
Litigation
News, the publication of the Litigation Section of the
Virginia State Bar, in its Spring 2007 edition published
an article by Philip G. Gardner entitled “Motor Vehicle
Crash Data Recording Systems”. This article, the second
article published by Litigation News and authored by
Philip G. Gardner, is an overview of crash data
recording devices in motor vehicles and the
admissibility and use of such data in court.
LEN BARROW SUCCESSFUL ON APPEAL
On September 14, 2007, the Virginia Supreme
Court released its opinion in the case of Dalton v.
Yodit, et als. Len Barrow served as co-counsel with
nationally known UCC Secured Transactions Expert,
Barkley Clark, Esq., in a case of first impression in
Virginia involving conflicting priority claims between
secured parties to a lost Note. The Supreme Court
reversed the trial court and ruled in favor of the
firm’s client, Reliant Financial, Inc.
THEY’RE BROTHERS IN LAW

COLLINSVILLE, Va. … In December, Grady
Boatman, a 25-year-old courier driver from Stanleytown,
faced the distressing possibility of spending the rest
of his life in jail.
Witnesses said Boatman entered the Stanley Furniture
factory April 30, searching for Daniel Musselman, a man
he believed had recently taken advantage of his wife,
Melek. Other witnesses at the factory said Boatman shot
Musselman at least eight times with a .40-caliber
pistol.
Henry County Commonwealth's Attorney Bob Bushnell
passionately argued for a first-degree murder
conviction, citing what he called `overwhelming`
evidence that Boatman went to the factory planning to
kill Musselman......

Reynolds Makes Move to Private Firm

DANVILLE, Va. - The most memorable case for attorney
James Reynolds came in January 1999, when he
successfully prosecuted Claude Henry Mazza for
defrauding an elderly woman out of thousands of dollars
for roofing repairs she never needed.
Mazza is serving a 20-year prison sentence.
“(Prosecuting the case) was standing up for someone who
couldn’t protect themselves,” Reynolds said. “We got the
best possible result in terms of making sure he wasn’t
in the position to do that to anybody else for a long,
long time.”
These
days, Reynolds is still fighting for those unable to
fight for themselves. Only now, he is doing it on the
other side of the fence......
